Artwork License Agreement

This Artwork License Agreement governs all purchases made through Making Sense. By placing an order, you agree to be bound by this Agreement in addition to our Terms of Service.

This Agreement is made between:

Licensor: Marita Tvinnereim/Making Sense, Norway, post@making-sense.no, VAT 934759834, the creator and copyright owner of all artworks.
Licensee: Any customer, buyer or approved third-party production partner involved in the fulfilment of purchased products.

1. Scope and Usage Rights

1.1. The Licensor grants the Licensee a limited, non-exclusive, non-transferable license to use the purchased artwork strictly for personal display through officially produced Making Sense products.

1.2. The purchase of a physical artwork or print grants ownership of the physical item only. Copyright, intellectual property rights and reproduction rights remain solely with the Licensor.

1.3. Approved third-party fulfilment partners used by Making Sense may temporarily process digital artwork files solely for the purpose of producing official products. These partners are not granted independent usage rights to the artwork.

2. Restrictions

2.1. The Licensee is not permitted to:

• Print or reproduce the artwork in any format, including personal printing
• Scan, copy, photograph or digitally reproduce artworks for reproduction purposes
• Sell, redistribute or share digital artwork files
• Modify, edit, crop, recolor or otherwise manipulate the artwork
• Use the artwork in branding, marketing, logos or commercial products
• Use the artwork for editorial or commercial publication without written permission
• Use the artwork in NFTs, blockchain products or mass production
• Use the artwork for artificial intelligence training, machine learning datasets or generative model development

2.2. Any unauthorized use constitutes copyright infringement and may result in legal action.

3. Duration and Termination

3.1. The license becomes effective upon purchase and remains valid as long as the Licensee complies with this Agreement.

3.2. Any breach of this Agreement grants the Licensor the right to immediately revoke the license and pursue legal remedies if necessary.

4. Copyright and Ownership

4.1. All artworks remain the exclusive intellectual property of the Licensor.

4.2. No copyright or reproduction rights are transferred through purchase unless explicitly agreed in writing.

5. Limitation of Liability

5.1. The Licensor is not responsible for damages, losses or claims arising from misuse of the artwork by the Licensee or third parties.

6. Governing Law

6.1. This Agreement is governed by the laws of Norway. Any disputes shall be resolved under Norwegian jurisdiction.
