Artwork License Agreement

This Artwork License Agreement applies to purchases made through Making Sense. By placing an order, you agree to be bound by this Agreement in addition to my Terms of Service.

This Agreement is made between:

Licensor: Marita Tvinnereim/Making Sense, Norway, post@making-sense.no, VAT 934759834, the creator and copyright owner of all artworks.
Licensee: The customer who purchases a Making Sense artwork or product.

1. Scope and Usage Rights
1.1. The purchase of a physical artwork or print grants the Licensee ownership of the physical item only. Copyright, intellectual property rights and reproduction rights remain solely with the Licensor.

1.2. The Licensee is granted a limited, non-exclusive, non-transferable right to display the purchased artwork or print for personal, non-commercial purposes.

1.3. Approved third-party fulfilment partners used by Making Sense may temporarily access and process digital artwork files solely for the purpose of producing and fulfilling Art Print orders. These partners are not granted independent rights to use, reproduce or distribute the artwork.

2. Restrictions
2.1. The Licensee is not permitted to:

• Print or reproduce the artwork in any format, including personal printing.
• Scan, copy, photograph or digitally reproduce the artwork for reproduction purposes.
• Sell, redistribute or share digital artwork files.
• Modify, edit, crop, recolor or otherwise manipulate the artwork for reproduction or commercial use.
• Use the artwork or reproductions of it in branding, marketing, logos or commercial products.
• Use the artwork or reproductions of it for editorial or commercial publication without written permission.
• Use the artwork in NFTs, blockchain products or mass production.
• Use the artwork for artificial intelligence training, machine learning datasets or generative model development.

2.2. The Licensee may display the purchased physical artwork or print for personal, non-commercial purposes.

2.3. Any unauthorized use of the artwork or its reproductions may constitute copyright infringement and may result in legal action.

3. Duration and Termination
3.1. The license becomes effective upon purchase and remains valid as long as the Licensee complies with this Agreement.

3.2. Any breach of this Agreement gives the Licensor the right to revoke the license and pursue legal remedies if necessary.

4. Copyright and Ownership
4.1. All artworks remain the exclusive intellectual property of the Licensor.

4.2. No copyright, intellectual property or reproduction rights are transferred through the purchase of an artwork or print unless explicitly agreed in writing.

5. Limitation of Liability
5.1. The Licensor is not responsible for damages, losses or claims arising from unauthorized use, reproduction or misuse of the artwork by the Licensee or third parties.

5.2. Nothing in this Agreement limits any rights or remedies that the Licensee may have under applicable law.

6. Governing Law
6.1. This Agreement is governed by the laws of Norway.

6.2. Nothing in this Agreement affects any mandatory consumer rights or protections that apply under the laws of the country where the Licensee resides.
